Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Axiom Pro application, including the Axiom desktop apps for Windows and macOS (collectively, the "Service"), provided by Axiom ("Axiom," "we," "us," or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts in your jurisdiction to use the Service. You are responsible for ensuring that your use of the Service complies with all laws and regulations applicable to you, including those relating to cryptocurrency trading in your jurisdiction.

2. Non-Custodial Service

Axiom is a non-custodial, on-chain trading terminal. We do not hold, control, or have access to your private keys, seed phrases, or digital assets at any time. You are solely responsible for the security of your wallet, private keys, and any credentials used to access the Service. Axiom cannot recover lost keys or reverse on-chain transactions.

3. Description of Service

The Service provides tools for interacting with the Solana blockchain and connected protocols, including token discovery, order execution, wallet and social tracking, MEV-resistant execution paths, perpetual futures access via third-party protocols (including Hyperliquid), and yield products via third-party integrations (including Marginfi). Availability of specific features may vary by platform and region.

4. Assumption of Risk

Trading digital assets involves significant risk, including the risk of total loss. You acknowledge and accept these risks in full, as further described in our Risk Disclosure. Nothing in the Service constitutes financial, investment, legal, or tax advice.

5. Prohibited Conduct

• Using the Service for any unlawful purpose, including market manipulation or fraud
• Attempting to interfere with, disrupt, or gain unauthorized access to the Service or connected infrastructure
• Reverse-engineering, decompiling, or redistributing the Service without authorization
• Using the Service in violation of applicable sanctions or export control laws

6. Intellectual Property

The Service, including its name, logo, design, and underlying software, is owned by Axiom and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the maximum extent permitted by law, Axiom shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or digital assets, arising from or related to your use of the Service.

9. Indemnification

You agree to indemnify and hold harmless Axiom and its affiliates from any claims, damages, liabilities, and expenses arising from your use of the Service or violation of these Terms.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
